PharmaDive Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of the PharmaDive WordPress plugin (“Plugin”), provided by Philadelphia Psychometric Matching LLC (“Company”, “we”, “us”, or “our”) via mooremetrics.com. By checking the box indicating your agreement to these Terms, accessing, or using the Plugin, you agree to be bound by these Terms. If you do not agree, do not use the Plugin.

1. Description of the Plugin
The Plugin is an informational tool that analyzes user-provided inputs related to pharmaceutical compounds and suggests similar compounds based on proprietary data. It is intended solely for educational, research, or general informational purposes. The Plugin does not provide, and is not a substitute for, medical advice, diagnosis, treatment, prescriptions, or any professional healthcare services. Outputs are generated algorithmically and are not personalized to any individual’s health condition, medical history, or needs.

2. No Medical or Professional Advice
THE PLUGIN IS NOT A MEDICAL DEVICE, IS NOT FDA-APPROVED OR REGULATED, AND DOES NOT PROVIDE MEDICAL, PHARMACEUTICAL, OR HEALTH ADVICE. ALWAYS CONSULT A LICENSED PHYSICIAN, PHARMACIST, OR QUALIFIED HEALTHCARE PROFESSIONAL FOR ANY QUESTIONS REGARDING MEDICATIONS, TREATMENTS, OR HEALTH CONDITIONS. DO NOT USE THE PLUGIN’S OUTPUTS TO MAKE DECISIONS ABOUT YOUR HEALTH, MEDICATION USE, OR TREATMENT. NEVER DISREGARD PROFESSIONAL MEDICAL ADVICE OR DELAY SEEKING IT BASED ON INFORMATION FROM THE PLUGIN.

By using the Plugin, you acknowledge that:

Recommendations (results given) are not endorsements, guarantees of safety, efficacy, compatibility, or suitability.
The Plugin does not account for individual factors such as allergies, interactions, dosages, side effects, or contraindications.
No doctor-patient, pharmacist-patient, or professional relationship is created with the Company or its affiliates.

3. User Eligibility and Responsibilities

You must be at least 18 years old and legally capable of entering into binding agreements to use the Plugin.
You agree to provide accurate, non-misleading inputs and to use the Plugin only for lawful, non-commercial purposes.
You are solely responsible for any actions, decisions, or outcomes resulting from your use of the Plugin’s outputs.
You must not use the Plugin in any way that could harm others, violate laws, or infringe on third-party rights.

4. Intellectual Property
The Plugin, including its algorithms, data, code, visualizations, and content, is owned by the Company and protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, revocable license to use the Plugin for personal use only. You may not copy, modify, distribute, reverse-engineer, or create derivative works from the Plugin without our express written permission.

5. Disclaimer of Warranties
The Plugin is provided “AS IS” and “AS AVAILABLE” without any warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, completeness, reliability, or non-infringement. We do not guarantee that the Plugin will be error-free, uninterrupted, secure, or free from viruses. Data and outputs may be based on third-party sources and are subject to change without notice.

6. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES (INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, PERSONAL INJURY, OR OTHER INTANGIBLE LOSSES) ARISING FROM OR RELATED TO YOUR USE OF THE PLUGIN, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total aggregate liability to you for any claims shall not exceed $100 USD.

7. Indemnification
You agree to indemnify, defend, and hold harmless the Company, its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Plugin; (b) your violation of these Terms; (c) your inputs or actions based on outputs; or (d) any third-party claims related to your conduct.

8. Governing Law and Dispute Resolution
These Terms shall be governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict of law principles. Any disputes arising under or related to these Terms shall be resolved exclusively in the state or federal courts located in Philadelphia, Pennsylvania. You consent to the personal jurisdiction of such courts.

9. Changes to Terms
We may modify these Terms at any time. Changes will be posted at https://www.mooremetrics.com/pharmadive-terms-and-conditions/. Your continued use of the Plugin after changes constitutes acceptance of the updated Terms.

10. Termination
We may terminate or suspend your access to the Plugin at any time, without notice or liability, for any reason, including suspected violation of these Terms.

11. Miscellaneous
If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in effect. These Terms constitute the entire agreement between you and the Company regarding the Plugin.
